The Health Insurance Portability and Accountability Act of 1996 (HIPAA) created new rights for patients, including the right to receive information regarding your health care providers? privacy practices. Under the law, Red Cross Pharmacy must provide you with a Notice of our privacy practices, and ask that you sign an acknowledgement stating that we gave it to you. This is the Summary of our Notice, which is being provided to you at the same time as our full Notice. You may read the full Notice immediately or at a later time. You should read it carefully because it explains: ? How we use your health information in general; ? Red Cross Pharmacy?s right to use or disclose your health information for treatment, payment, or health care operations without your consent or authorization; ? Other circumstances where we may use or disclose your health information without first obtaining your authorization; ? Red Cross Pharmacy?s obligations regarding your health information; ? How to register a complaint about your privacy at Red Cross Pharmacy; ? Your rights regarding your health information at Red Cross Pharmacy, including: o Your right to have a copy of our Privacy notice; o Your right to review and obtain a copy of your health information; o Your right to authorize the use or disclosures of your health information and your right to subsequently revoke that authorization; o Your right to an accounting for how your health information is used or disclosed; o Your right to request that we communicate with you by an alternative means or at an alternative location; o Your right to request restrictions on the use or disclosure of your information; o Your right to request an amendment to information in your records that you think is in error; and o Your right to file a complaint if you believe your privacy rights have been violated. We at Red Cross Pharmacy are dedicated to maintaining the privacy of your Protected Health Information (?PHI?) and only using your PHI as necessary or as required by law. PHI is any information that we possess, use and disclose that identifies you and relates to your past, current or future physical and mental health condition or illness and the health care products and services that have been provided to you. This ?Notice of Privacy Practices? (Notice) describes how we may use and disclose PHI about you to carry out treatment, payment, or health care operations and for other specified purposes that are permitted or required by law. This Notice also describes your rights with respect to your PHI If a use and disclosure of your PHI is not contained in this Notice, then we will always obtain your written authorization before the use and disclosure. For example, we would never sell your PHI to any third party for that party?s own purposes without obtaining your authorization. If an authorization is requested, we will provide you with a form that describes the proposed use and disclosures and your rights related to the requested authorization. Any authorization you provide to use regarding the use and disclosure of your PHI may be revoked at any time in writing. Red Cross Pharmacy is required and committed to follow the terms of this Notice. We do, however, reserve the right to change our practices and this Notice to make the new Notice effective for all PHI we maintain. Upon request, we will provide a revised Notice to you. YOUR RIGHTS WITH RESPECT TO YOUR PHI The Health Insurance Portability and Accountability Act of 1996 (HIPAA) provides you with several rights related to your PHI, which are summarized below. If you would like more information about any of these, please contact our Pharmacy Privacy Officer at the address or telephone number of our pharmacy. You have the right to receive this written Notice of Privacy Practices at any time, even if you have agreed to receive the Notice electronically. You have the right to request restrictions on our use or disclosure of your PHI to carry out treatment, payment, or health care operations, or to restrict uses and disclosures to family members, relatives, friends, or other persons identified by you who are involved in your care or payment for your care. All requests for limitations on the use and disclosure of your PHI must be submitted to our Pharmacy Privacy Officer in writing using a form that we will provide to you. However, we are not required to agree to your request. You have the right to inspect and copy your PHI. We may charge you a fee for the costs of copying, mailing or other supplies that are necessary to grand your request. All requests to review or receive photocopies of our records that contain your PHI must be submitted to our Pharmacy Privacy Officer in writing using a form that we will provide to you. We may deny your request to inspect and copy in certain limited circumstances. If you are denied access to your PHI, you may request that the denial be reviewed. You may ask us to amend your PHI if you believe it is incorrect or incomplete. You must provide us with a reason that supports your request for amendment. In certain cases, we may deny your request for amendment. If we deny your request for amendment, you have the right to file a statement of disagreement with the decision, to which we may elect to further respond in writing to you. All requests for changes to your PHI must be submitted to our Pharmacy Privacy Officer in writing, using a form that we will provide to you. You have the right to request that we communicate with you about your health and related issues in a particular manner, or at a certain location. For instance, you may ask that we contact you only in writing or at a different residence or post office box. All requests regarding confidential communications must be submitted to our Pharmacy Privacy Officer in writing, using a form that we will provide to you. We will accommodate all reasonable requests. You have the right to obtain an accounting of some of our disclosures of your PHI made after April 14, 2003 for most purposes other than treatment, payment or health care operations. The accounting will not include disclosures we have made directly to you or disclosures that have been authorized by you, or disclosures made to friends or family members involved in your care. The first accounting you request in a 12 month period will be provided free of charge, but you may be charged for the cost of providing additional accountings. All requests for an accounting of our disclosures of your PHI must be submitted to our Pharmacy Privacy Officer in writing, using a form that we will provide to you. You have the right to complain if you believe that your privacy rights have been violated, and you may complain either directly to us or to the Secretary of the Department of Health and Human Services, Hubert H. Humphrey Building, 200 Independence Ave SW, Washington, DC 20201. You will not be retaliated against for filing a complaint. All complaints submitted directly to our Pharmacy Privacy Officer must be in writing, using a form that we will provide to you. WAYS THAT WE MAY USE AND DISCLOSE YOUR PHI WITHOUT YOUR AUTHORIZATION Treatment ? Where PHI is used or disclosed in providing, coordinating, or managing your healthcare. For example, the pharmacist may need to consult with your physician regarding your medications, treatment or condition. Payment ? Where PHI is used or disclosed to obtain or provide reimbursement. For example, we may contact your health insurer to certify that you are eligible for benefits, and we may provide your insurer with details regarding your treatment to determine if your insurer will pay for your medications or pharmaceutical care services. Health Care Operations ? HIPAA defines health care operations as those activities necessary and related to our providing of health care products and services to you. For example, we may use or disclose your PHI to evaluate the quality of care you received from us, or to conduct cost-management and business planning activities. We may also disclose your PHI to business associates who perform services on our behalf in helping us to carry out our health care functions. In addition, we may contact you to provide refill reminders, or information about treatment alternatives or other health related benefits and services that may be of interest to you. Required by Law ? We will use or disclose your PHI when required by applicable law. For example, we are required to submit periodic reports that contain PHI related to certain controlled substance prescriptions obtained at the pharmacy. Public Health Activities ? We may use or disclose your PHI for public health activities such as to report adverse drug events to the FDA or to enable drug recalls. Abuse, Neglect, and Domestic Violence ? We may disclose your PHI to a government authority if we reasonably believe you are a victim of abuse, neglect, or domestic violence. We will only disclose this type of information to the extent required by law, if you agree to the disclosure, or if the disclosure is allowed by law and we believe it is necessary to prevent serious harm to you or someone else or the law enforcement or public official that is to receive the report represents that it is necessary and will not be used against you. Health Oversight Activities ? We may use or disclose your PHI to a health oversight agency for activities required by law. For example, public health care insurance programs that may provide or pay for your health care can conduct audits, inspections, and investigations of us in relation to our activities and your activities. We may also use or disclose your PHI related to licensure and disciplinary actions, civil, administrative, and criminal procedures or actions. Judicial and Administrative Proceedings ? If you are involved in a lawsuit or dispute, we may disclose PHI about you in response to a court or administrative order. We may use or disclose your PHI to organizations that handle organ and tissue procurement, banking, or transplantation. Serious Threat to Health or Safety ? We may use and disclose your PHI when necessary to prevent a serious threat to your health and safety or the public or another person. Specialized Government Functions ? We may disclose your PHI if you are a member of U.S. or foreign military forces (including veterans) and if required by the appropriate military command authorities. We may also disclose your PHI to federal officials for intelligence and national security activities authorized by law, as well as to federal officials in order to protect the President, other officials, or foreign heads of state, or to conduct investigations. Further, we may disclose your PHI to correctional institutions or law enforcement officials if you are an inmate or under the custody of a law enforcement official. Workers? Compensation ? We may disclose your PHI to the extent authorized by and to the extent necessary to comply with laws relating to worker?s compensation or other similar programs established by law. Pennsylvania Law ? We will follow Pennsylvania Law when it provides additional protection for the privacy of your PHI. For example, pursuant to Pennsylvania?s Confidentiality of HIV-Related Information Act, we will not disclose any HIV-related information, except in situations where the subject of the information has provided us with a written consent allowing the release, or where we are authorized or required by state or federal law to make the disclosure. We will also abide by Pennsylvania Law?s additional privacy protection for PHI related to mental health treatment and drug and alcohol abuse. We may refuse to continue to treat a customer that revokes his or her consent. Example of How We May Use and Disclose PHI The following categories describe and provide examples of different ways we use and disclose PHI about you. We will use PHI for treatment. Example: Information obtained by the pharmacist will be used to dispense prescription medications to you. We will document in your record information related to the medications dispensed to you and services provided to you. We will use PHI for payment.
